Considering applying for Academy status?
Following the Government’s invitation to all schools in England to apply for Academy status, over 1,000 schools have registered their interest with the Department for Education. If your school is one of them, or you are considering finding out more about the conversion process, then Myers Clark can help!
We have a wealth of experience within the not-for-profit sector, including working with independent schools and Academies. Our specialist team has helped schools successfully set up as new legal entities including appointing directors, applying for charitable registration, and preparing and filing accounts.
We are therefore able to offer help and advice throughout the conversion process, including:
- setting up and registering the Academy Trust with Companies House, including completing the Memorandum and Articles of Association for the newly-formed Trust
- ensuring the Academy complies with charity and company law and the obligations in the Funding Agreement
- where applicable, helping with asset and property transfer arrangements
- registering with the Charity Commission (or the Government-appointed principal regulator, depending on the outcome of the current Academies Bill)
- advising on the suitability of the school’s existing financial systems
- once established we are then able to assist with payroll and management accounting, together with year end accounts preparation and audit, which will be required in order to comply with the relevant legislation.
Should you decide to apply for Academy status, we would welcome the opportunity to discuss the process with you further. For more information, please email Paul Windmill, Head of our Not-for-Profit Team, or telephone Paul on 01923 224411.
